Is It Illegal To Sale Candy, Chips, Soda, Hot Dogs, And Icee Cups Out Of Your House Without A Business License

The food license is harder to get than the business license…although your zoning may not permit the business license either.
In California, you cannot cook food for public consumption in a residence. And the place you do cook it has to have particular kinds of flooring and goodness-knows-what else. I don’t know the rules in your state.

    Lemonade stand only counts for kids.
    You need to check with your local, county and state governments. Most will not only require a business license but with anything that is not prepackaged they will also require you to get a health license and food license too. That means if you prepare drinks and food like hot dogs you will need to follow strict health codes. And if you have pets in the house you will NOT be cleared to do it, reguardless of your local laws.

    Yes and technically even a kids lemonade stand needs to be licensed and checked for cleanliness. Most authorities will let the kid slide on the beverage stand but if you wish to sell food call your local chamber of commerce for a packet on starting a home based business and what licenses and requirements you are required to follow.
